ARTICLE 1. PURPOSE - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1.1. These general conditions of sale define:
The terms of sale on the website https://shop.maisonmoga.fr (hereinafter referred to as the “MAISON MOGA Site”) from which the products distributed by Maison MOGA (hereinafter referred to as “MAISON MOGA Products” are marketed ») to natural persons or companies for their personal use, as well as the rights and obligations of the parties arising from the process of online sale. The Maison Moga Site is referred to as the "Site". The products are together referred to as the "Products". These General Conditions of Sale are concluded between a natural person or a company wishing to make a purchase via the Site (hereinafter referred to as the “Customer”) and the MAISON MOGA Company, whose full contact details are as follows: - Maison Moga, FR27824808950 Intra-community VAT and headquartered at 3 cours Anatole France - 84800 L'Isle-sur-la-Sorgue, France (hereinafter referred to as “Maison Moga”). Thus, by ordering a Product on the Maison Moga Site, the Customer acknowledges:
- that he has full legal capacity;
- that he is a non-commercial adult, a natural person acting for their personal needs
- that by ordering a Maison Moga Product via the Site, he will accept the general conditions of sale with Maison Moga;
- that his order is governed by these General Conditions of Sale, which the Customer declares to accept the terms without restriction or reservation. Any order constitutes acceptance, without reservation, of these General Conditions of Sale. This acceptance is in no way conditioned by a handwritten signature from the Customer. In accordance with the provisions of Articles 1316 to 1316-4 of the French Civil Code, it is recalled that the validation of the order form as specified in Article 3 constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.
The contract resulting from the actual order of the Customer comes under the regulations of distance selling, as it results in the legislative and regulatory provisions applicable in France as well as the provisions set out below that the customer undertakes to fully accept when placing an order.
1.2. Any special condition or any other written document presented by the Customer (including the present order) cannot prevail over these General Conditions of Sale without the previously written approval and consent of Maison Moga.
It is indicated that the Customer can save or print these General Conditions of Sale, under the exclusive condition to not modify or edit them at all.
1.3. La Maison Moga reserves the right to modify these General Conditions of Sale without prior notification. Any new version of these will be reported to the Customer on the Site, the Customer is responsible to be fully informed of them.
The online version of these General Conditions of Sale on the Sites will prevail, where applicable, over any other version of said General Conditions of Sale, with the exception, in accordance with common law, of changes which may have occurred after an order from the Customer.
